Terms of Service

Agreement

By accessing or using The Vibe Marketer ("the Platform"), including our website at thevibemarketer.com, the Daily Ads service at ads.thevibemarketer.com, the community, and the skills marketplace, you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

Our Services

The Vibe Marketer provides:

• Daily Ads — An AI-powered service that generates ad creatives based on your brand profile, competitor analysis, and user feedback. Available in free and paid tiers.
• Community — A members-only space for marketers to share strategies, get feedback, and connect with peers.
• Skills Marketplace — Digital marketing skills, templates, and resources available for purchase and download.

Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. One person or entity per account — sharing account credentials is not permitted.

We reserve the right to suspend or terminate accounts that violate these terms, engage in abusive behavior, or are used for fraudulent purposes.

Daily Ads — Free Tier

The free tier provides a limited number of lifetime ad generations to evaluate the service. Free tier usage is subject to fair use — automated or bulk generation via scripts, bots, or API abuse is prohibited. We reserve the right to limit or revoke free tier access at our discretion.

Subscriptions & Billing

Paid plans (Spark, Growth, Agency) are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

• Subscriptions renew automatically each billing cycle
• You can cancel at any time from your billing settings — access continues through the end of your current billing period
• We do not offer prorated refunds for partial months
• Price changes will be communicated at least 30 days in advance
• Failed payments may result in service interruption after a grace period

Skills Marketplace

Skills and digital products purchased from the marketplace are delivered digitally. All sales are final. If a product is materially different from its description, contact us within 14 days for a resolution.

You receive a personal, non-transferable license to use purchased skills for your own business purposes. Redistribution, resale, or sharing of purchased skills is not permitted.

Content Ownership

Your Content

You retain ownership of your brand profiles, reference images, and any content you upload. By using Daily Ads, you grant us a limited license to process your content through AI services for the purpose of generating ad creatives.

Generated Content

Ad creatives generated by Daily Ads (concepts, copy, and images) are yours to use for any commercial purpose, including running paid advertising campaigns. You receive a perpetual, royalty-free license to use all generated content. We do not claim ownership of AI-generated outputs created for your account.

Our Content

The Platform itself — including design, code, skills content, educational materials, and branding — is owned by The Vibe Marketer and protected by intellectual property laws.

AI-Generated Content Disclaimer

Daily Ads uses artificial intelligence to generate ad concepts and images. While we strive for high quality, AI-generated content:

• May require review and editing before use in live campaigns
• Is not guaranteed to comply with all advertising platform policies (Meta, Google, etc.) — you are responsible for ensuring compliance before running ads
• May occasionally produce inaccurate, inappropriate, or low-quality outputs
• Should be reviewed for trademark, copyright, or brand safety concerns before publication

You are solely responsible for reviewing and approving all generated content before use. We are not liable for the performance, compliance, or consequences of running AI-generated ad creatives.

Community Guidelines

When participating in our community, you agree to:

• Be respectful and constructive in all interactions
• Not spam, self-promote excessively, or share misleading information
• Not share confidential or proprietary information belonging to others
• Not engage in harassment, discrimination, or abusive behavior

We reserve the right to remove content and restrict access for community members who violate these guidelines.

Acceptable Use

You agree not to:

• Use the Platform for any illegal purpose
• Generate ad content that promotes illegal products, services, or activities
• Attempt to reverse-engineer, scrape, or extract our AI prompts, skills, or proprietary systems
• Circumvent usage limits, rate limits, or tier restrictions
• Resell or redistribute generated content as a competing service
• Use automated tools to access the Platform beyond normal browser usage
• Impersonate another person or entity

Service Availability

We aim for high availability but do not guarantee uninterrupted service. The Platform depends on third-party AI providers, payment processors, and infrastructure services that may experience downtime. We are not liable for service interruptions caused by third-party outages.

We may modify, suspend, or discontinue features with reasonable notice. For paid subscribers, we will provide at least 30 days notice before discontinuing core features of your plan.

Limitation of Liability

To the maximum extent permitted by law, The Vibe Marketer is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

We are not responsible for ad campaign performance, advertising platform account status, or business outcomes resulting from use of generated content.

Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or prominent notice on the Platform. Continued use after changes take effect constitutes acceptance.
